Terms & Conditions

Artmark provides the content and services available on the Site subject to the following “Terms and Conditions”. By accessing or using the Site, you hereby acknowledge that you have read, understood, and agreed, without limitation or qualification, to be bound by these Terms & Conditions including Privacy Policy and Online Purchase Policy.


Purchase Policy

(a) Orders 

All prices are subject to taxes, unless otherwise stated.

All orders placed are subject to Artmark’s acceptance, we reserve the right to accept or decline any and all orders received from or through the Site in our sole and absolute discretion including orders from distributors, dealers, warehouses.

Artmark reserves the right to make adjustment to the price of any product without giving any reason or prior notice. Product prices on the Site  website may be different with the prices at Artmark store.

In the event an error is discovered in the price of an item ordered, customers will be notified as soon as possible to reconfirm their purchase. We shall in no case be under the obligation to fulfil the order listed at the incorrect price. If an order is already fulfilled before discovery of the error, we reserve all rights for retrieval of goods and refund customer of purchase price or charge correct amount.

Unless in contrary to any applicable law, customers may not cancel any accepted order that without written agreement from Artmark.

(b) Delivery

Neither Artmark nor our agents shall be liable for any costs or damage arising out of delay or non-delivery howsoever caused.

Artmark reserves rights to deliver the order in instalments.

(c) Rates and Price Variation

Artmark reserves the right unilaterally to vary the contract price to take account of any upward variation due to factors beyond control between the date of the purchase and the date of delivery. 


Exchange & Return Policy

Customers are able to exchange products within 7 days of receipt date. Product shall be un-used, product tags shall not be tampered with, and the product shall be in the original brand packaging (if applicable). This policy is applicable only to those products which do not fall under the list of non-refundable brands/items provided on our Site.

Customer shall ensure that the product is exchanged in the same condition as it was when received and is packaged properly. In the event that an item is returned in an unsuitable condition, Artmark reserve the right not to accept exchange and return.

Artmark do not offer exchange on used, damaged or non-resaleable in the same condition at the point of sale - all packaging, label should be intact. 

No cash or credit card refund is allowed, only an exchange with in-stock products will be permitted.

Brushes
  • Brush handle and brush hair should be unused, tempered, scratched, blemished
  • Glue on brush hair should remain intact
  • Individual pieces within sets cannot be exchanged with other sets, colour, series

Paints
  • Paint bottle and tubes should be unused, tempered, scratched, blemished
  • Paint should remain in original composition - not mixed with other paint, water, solvents
  • Individual pieces within sets cannot be exchanged with other sets, colour, series

Paper
  • Paper or paper pad should be unused, tempered, scratched, blemished
  • Paper pad should contain same number of sheets as described on Site or store

Pen
  • Pens should be unused, tempered, scratched, blemished
  • Pens with tip protector should be returned with the same protector
  • Fountain pen nibs should not be tempered, scratched, blemished
  • Individual pieces within sets cannot be exchanged with other sets, colour, series

Pencils
  • Pencils should be unused, tempered, scratched, blemished
  • Wooden pencils should not be sharpened
  • Lead within mechanical pencils should not be broken
  • Eraser  should be unused, tempered, scratched, blemished
  • Individual pieces within sets cannot be exchanged with other sets, colour, series

Incorrect & Faulty Products

In the event that an incorrect product is delivered, customers may choose to replace the items with Artmark. Notify Artmark with the order reference and the specific product. Further advice will be provided on the replacement and delivery details.

No replacement will be made for defects that are obvious as it would be spotted at point of delivery. For the same reason inks, markers, nibs, paints, pencils and disposable pens are strictly not exchangeable or returnable after you leave the retail store or 7 days from invoice date.

Due diligence should be made when in receipt of product. Customers are encouraged to inspect products during delivery. For the same reason inks, markers, nibs, paints, pencils and disposable pens are strictly not exchangeable or returnable after you leave the retail store or 7 days from invoice date.


Lemon Law

In the event a product is found to be defective or faulty, customers may request for a replacement or exchange in Artmark’s retail store. However, no cash or credit card refunds is permitted.

Customers may not take advantage of the Lemon Law, regardless of the time limit, if:
  • Item is damaged due to abuse, misuse, inappropriate storage or care, unauthorised repair of the user
  • Defect was caused by natural wear and tear.
  • Defect in the item was known before purchase (including faults caused by regular wear and tear) 
  • Defect was specifically made known before the purchase
  • Defects is obvious as it would be spotted at point of delivery. For the same reason inks, markers, nibs, paints, pencils and disposable pens are strictly not exchangeable or returnable.
  • There is a change of mind on purchase 
  • Products that fall short of your expectations of appearance, colour, quality, usage etc are not considered as defective
